"Now we media, especially WeChat, have brought a great challenge to copyright protection," Yan Xiaohong said. The challenge is not only limited to China, but also faced by other developed countries.
As for how to solve this problem, Yan Xiaohong believes that the first thing to look at is whether the content of the communication constitutes a work. If it constitutes a work, its dissemination should be licensed according to the current law, and the way to license it needs to be carefully studied. But at present, on the basis of the current law, as long as it constitutes a work, and the work has not been disseminated with the permission of others, it constitutes an infringement, including the reprinted work mentioned above.
Yan Xiaohong said that if the work does not belong to the scope of fair use, the rights should be agreed, and it cannot be used without the authorization of the obligee. So in this regard, the administrative department and the judicial department should strengthen their efforts.
